GP FOR REVENUE (AP) 2 HBKM,J W.P.No.6954 of 2020 The Court made the following Order: Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the 4th respondent in preparing layout to allot the house sites to the poor persons under the Navaratnalu Pedalandariki Illu Scheme in the subject land which is classified as Rastha situated in Sy.No.130-8 to an extent of Ac.0.41 cents of Thalada Village, Santhakaviti Mandal, Srikakulam District 2) the action of 4th respondent in threatening to dispossess the petitioner from the land situated in Sy.No.130-8 to an extent of Ac.0.23 cents out of Ac.0.41 cents of Thalada Village, Santhakaviti Mandal, Srikakulam District without following the due process of law. 3. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 4th respondent submits that the total extent of Ac.3.51 cents covered in Sy.No.130-5 to 130-15 have been acquired for the Social Welfare Land Acquisition for providing house sites to the poor people of Talada Village and the changes were incorporated on 09.11.1983. After assigning the house sites, there is an extent of Ac.0.23 cents available in Sy.No.130-5 as a vacant land at Talada Village in Santhakaviti Mandal, which was proposed for issuance of house site pattas to the weaker sections of Talada Village under the Welfare Scheme of the State. Whereas the land in Sy.No.130-8 in an extent of Ac.0.41 cents has been covered in Social Welfare 3 HBKM,J W.P.No.6954 of 2020 Land Acquisition and the petitioner is not in possession. In the above said land already the houses are in existence and the respondents are not proposing for any house sites in the said land of Sy.No.130-8. 4. In view of the above said facts and circumstances, as there is no proposal for any house sites in the Sy.No.130-8, no further orders are necessary in this writ petition. However, the respondent Nos.2 to 4 are directed to deal with the subject land strictly in accordance with law, if so warranted for any public purpose. 5. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
