ORDER: This Criminal Petition has been filed seeking to set aside the order dated 25.08.2025 passed NBW against the petitioner in S.C.N0.72 of 2019, on the file of the Court of the Hon’ble Principal District and Sessions Judge, Chittoor.
02. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor on behalf of the State.
03. The office objection is unsustainable. The office is directed to number the petition.

Learned counsel for the petitioner would submit that the petitioner herein is the de-facto complainant in S.C.No.72 of 2019 on the file of the learned Principal District and Sessions Judge, Chittoor. The petitioner could not attend the Court as a witness due to medical reasons. Consequently, the learned Trial Judge issued a Non-Bailable Warrant (NBW) against the petitioner. It is submitted that the petitioner was hospitalized due to a cardiac issue and hence could not appear before the Court. Learned counsel would further submit that when the witness was unable to attend on medical grounds, the learned Trial Judge ought to have recalled the witness instead of issuing the NBW.

05. Learned Assistant Public Prosecutor submits that the evidence of the de-facto complainant is essential for proper adjudication of the case and the Court may pass appropriate orders. Considering the
submissions made by both sides, the petition is
disposed of with a direction to the learned Trial Judge to entertain the application filed by the petitioner, fix a specific date for the examination of the de-facto complainant, and proceed with the trial as expeditiously as possible. No further adjournment shall be granted on mere asking.
06. Accordingly, the Criminal Petition is disposed of. There shall be no
order as to costs.
