Date : 09/09/2025 ORAL ORDER Heard learned advocates appearing for the repective parties. By way of present petition under Articles 226 and 227 of the Constitution of India read with section 482 of the CrPC (section 528 of the BNSS), petitioner is seeking direction of this Court to get the keys of Locker No.525 from the concerned Investigating Officer of the CBI, Gandhinagar and to direct the CBI to take all the belongings kept in Locker No.525. Petitioner Bank is under liquation and through Liquidator, the petitioner has applied to operate the locker No.525, which is already seized by the CBI by drawing panchnama and to get return the key of the said locker, the petitioner Bank has approached this Court. Learned advocate for the respondent No.2 submits that the
R/SCR.A/10296/2025 ORDER DATED: 09/09/2025 respondent No.2 has no objection if the key of Locker No.525 is handed over to the petitioner and locker is allowed to be operated by the petitioner, provided same is done by drawing panchnama alongwith videography, and belongings kept in the locker are ordered to be deposited before the concerned Court, if any found from the said locker. In view of above, present petition is disposed of with direction to respondent No.2 to hand over the key of Locker No.525 and the petitioner shall be permitted to operate Locker No.525, alongwith videography and photography of the process, in presence of respodent Nos.3 and 4, who are the original owners of the said locker, by drawing panchnama. If any belongings are found, then the same shall be deposited before the concerned Court by the petitioner and respondent Nos.3 and 4 shall have the liberty to file appropriate proceeding, if they are entitled to get such belongings. In that event, the concerned Court / authority shall have to decide such application independently on its own merits. Present petition is disposed of.
