Memo which is placed on record reads as under: “It is submitted that captioned petition was filed seeking for quashing complaint and FIR registered in Crime No.27/2024 for the offences punishable under section 306, 506, 34 of IPC and all further proceedings pursuant to the same. During the pendency of the captioned petition, Respondent Police have filed the Charge sheet against the petitioner for the offences punishable under Section 306, 506, 34 of IPC and even the Trial court i.e. Civil Judge and JMFC, Kushtagi vide it is order dated 19.04.2024 has taken cognizance of the said offence and issued summons to the petitioner. Therefore, petitioner seeks permission of this Hon’ble court to withdraw the captioned petition with the liberty to file a separate petition challenging the charge sheet, order taking cognizance and entire proceedings in C.C.
