JUDGMENT: (per Hon’ble Sri Justice Ravi Nath Tilhari)
H.M.O.P.No.39 of 2022 filed by the appellant/husband seeking divorce under Section 13(1)(ia) (ib) of the Hindu Marriage Act, 1955, was dismissed. The husband filed the present appeal.
2. I.A.Nos.1 and 2 of 2025 were filed to permit the respondent/wife for compromise and to record the said compromise.
3. The parties were referred to the mediation by order dated
05.11.2025. The Mediation and Conciliation Centre of this Court has submitted the report in ROC.No.1152/APHCMC/2025 dated 25.11.2025 that the matter has been amicably settled between the parties. The parties have mutually agreed to dissolve their marriage by mutual consent and the permanent alimony has also been settled at Rs.7,00,000/-, which has already been credited to the account of the wife through cheque.

4. Learned counsels for the parties, Ms.B.Radhika, learned counsel appearing for the appellant/husband and Sri K.Srinivas,
learned counsel representing Sri P.Kameswara Rao, learned counsel appearing for the respondent/wife, submits that in terms of agreement between the parties in the mediation, the parties shall file petition seeking divorce by mutual consent under Section 13B of the Hindu Marriage Act, 1955 before the competent Court and would take necessary steps in terms of the settlement with respect to the cases pending before the other courts.
5. Recording the same, I.A.Nos.1 and 2 are allowed. Consequently, the Civil Miscellaneous Appeal is disposed of making part of the settlement along with report of the mediator as part of this order. There shall be no order as to costs.
As a sequel, interlocutory applications pending if any, shall stand closed. ______________________ RAVI NATH TILHARI, J
