THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA I WRIT PETITION NO: 11534/2025 ORDER: This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:- “to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action on the part of the respondent Nos. 2 to 5 herein not initiating any steps to conduct the survey, demarcate and fix up the boundaries of the land of the petitioner in pursuance of the online application vide FSNV012300354598 dated 28.12.2023 in survey No. 15/2 an extent of Ac. 0.48 cents situated at Yentrikona village, Allavaram Mandal as per the registered sale deed dated 16.02.2000 and not issuing the fresh adangals as illegal, arbitrary and violative of Article 14, 21 and 300-A of the Constitution of India and consequentially to direct the respondent Nos. 2 to 5 to conduct the survey, demarcate and fix up the boundaries an extent of Ac. 0.48 cents situated at Yentrikona village, Allavaram Mandal as per the registered sale deed dated 16.02.2000 and issue fresh adangals as per the petitioner’s online application dated 28.12.2023 and pass such other order. ” 2. Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents. 3. Learned counsel for the petitioner submits that even though the petitioner submitted an application dated 28.12.2023 seeking for conducting survey and demarcation of the property, the respondents so far not conducted survey and not issued any other proceedings. Hence, the present Writ Petition. 3 4. On the other hand, learned Government Pleader for the th respondents furnished written instructions issued by the 4 respondent dated 03.05.2025, wherein it is stated that the respondents initiated steps for conducting survey and issued notices under Section 9(2) of the A.P. Survey and Boundaries Act, 1923. For which, the petitioner also submitted his objections under Section 10(1) of the Act, 1923. The said objections were under consideration to pass orders under Section 10(2) of the Act. In the meanwhile, the petitioner filed the present Writ Petition. It is further clarified that the respondents are under the process of enquiry and to pass orders, if the petitioner is not satisfied, he can prefer an appeal under Section 11 of the Act, 1923. 5. Having regard to the submissions made by the learned counsel for the petitioner and on perusal of the written instructions furnished by the learned Government Pleader for the respondents this Court deems it appropriate to dispose of the Writ Petition directing respondent Nos.4 and 5 to complete the entire exercise i.e., enquiry, survey and demarcation by considering the objections filed by the petitioner under Section 10(1) of Act, 1923, within a period of three(3) months from the date of receipt of copy of this Order. 6. With the above direction, the Writ Petition is disposed of.
