1. The petitioner has filed this writ petition under Article 226 of the MANISH YADAV Digitally signed by MANISH YADAV Date: 2025.09.16 10:55:20 +0530
2 Constitution of India for issuance of direction to respondents authorities to provide pension to the petitioner.
2. In the present case, there is dispute with regard to entitlement of pension of the petitioner as the mother of respondent No. 2 to 4 has already been granted pension.
3. It has been informed that the succession proceeding was initiated by Ahilyabai by filing an application under Section 372 of Hindu Succession Act before Civil Judge, Class-I, Bilaspur (C.G.), but the same shall be answered in favour of Naresh Kumar, Ramesh Kumar and Anita Suryavanshi and this order has not been assailed by the petitioner.
4. Since the competent Court has already held that Ahilyabai is not the legal heirs of late Shri Arjunlal Suryavanshi, therefore, this writ petition is disposed of granting liberty to the petitioner to assail the
order passed by the learned Civil Judge, Class-I Bilaspur (C.G.) in Succession Case No. 86/2021 before the appropriate forum available to him under the law.
5. Accordingly, the writ petition disposed of with the aforesaid liberty granted in favour of the petitioner.
