Heard the parties.
This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of A.B.A. No. 128 of 2025 to its original file.
Learned counsel for the petitioner submits that A.B.A. No. 128 of 2025 was rejected as not pressed vide order dated 17.01.2025. It is next submitted that due to inadvertence, the counsel for the petitioner could not mark the case, hence when the case was called out, no one could appear before the Court. It is next submitted that the petitioner has very good grounds to agitate in this anticipatory bail application. It is then submitted that non-appearance of the counsel for the petitioner was neither deliberate nor intentional and unless A.B.A. No. 128 of 2025 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that the A.B.A. No. 128 of 2025 be restored to its original file.
Considering the aforesaid submission of the learned counsel for the petitioner, A.B.A. No. 128 of 2025 is restored to its original file to the stage at which, it was before its dismissal.
List A.B.A. No. 128 of 2025 under the appropriate heading after a week.
