CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 2 23-06-2025 Heard the parties.
2. The petitioners were admitted in General Nursing and Midwifery Course for the Session 2021-2024 conducted by Bihar Nurses Registration Council, Shashtri Nagar, Patna. The petitioners were expecting their examination to be conduced in the month of October, 2024, but the same could not be done till date, in the meanwhile, Advertisement No. 23 of 2025 came to be published for selection to the post of Staff Nurse.
3. Learned Advocate for the petitioners would thus contended that on account of laches on the part of the Bihar Nurses Registration Council, the petitioners have been deprived from participating in the selection process; pursuant to the
Patna High Court CWJC No.9495 of 2025(2) dt.23-06-2025 3/4 Advertisement No. 23/2025 for appointment to the post of staff nurse. The said advertisement invited applications from the eligible candidates, having requisite qualification of General Nurses & Midwifery course, with the passing certificate and mark-sheet, to apply for the subjected post with effect from 25.04.2025 to 23.05.2025. Since the petitioners, as submitted by learned Advocate for the petitioners are not at fault and their examination could be held in time, hence they should be allowed to participate in the selection process in anticipation of their being successful in the General Nursing and Midwifery Course.
4. This Court is afraid to accept the submission of the petitioners; their cannot be any writ petition in anticipation of any event which has not yet been taken place. It is the admitted position that the petitioners have been pursuing their General Nursing and Midwifery Course for Session 2021-2024 and even the final examination could not be held, till date, thus they are having no requisite qualification for the subjected post. Hence, in such circumstances, the petitioners do not deserve any relief as sought for.
5. Learned Advocate for the Bihar Technical Service Commission, at this stage, apprise this Court that similar issue
Patna High Court CWJC No.9495 of 2025(2) dt.23-06-2025 4/4 came up for consideration in CWJC No. 5464 of 2025, wherein some of the candidates of D. Pharma have approached this Court for identical relief. However, it came to be dismissed vide
order dated 08.04.2025, on being found the petitioners have no requisite qualification.
6. Considering the aforesaid facts and the nature of the relief sought for, this Court does not find any reason or occasion to entertain the writ petition. Accordingly, the present writ petition stands dismissed.
