Heard learned counsel for the petitioners, learned counsel for the respondent and learned A.G.A. for the State respondents. The present writ petition has been preferred with the prayer to quash the impugned First Information Report dated 07.04.2025, registered as Case Crime No.65 of 20215, under sections- 323, 504, 506, 354B, 376, 498A IPC and Section 3/4 of Dowry Prohibition Act, Police Station Gang, District Rampur, and for a direction to the respondents not to arrest the petitioner in pursuance of impugned First Information Report. Mr. Ravti Raman Patel, learned Advocate holding brief of Mr. Ashok Kumar Patel, counsel for the respondent No.4 informed this Court that chargesheet has already been filed on 29.04.2025 in this case. However, he is not certain that whether cognizance has been taken by the court on chargesheet or not. Petition is disposed of directing that till cognizance is taken on police report under Section 173(2) Cr.P.C., by the court the respondents shall not arrest the petitioners pursuant to the aforementioned case, subject to cooperation in ongoing investigation. In case, the petitioners do not cooperate the investigation, it shall be open for the Investigating Officer to file a recall application before this Court through learned A.G.A.
