1. Heard Mr. Pawan Shrivastava, learned counsel for the petitioner. Also heard Mr. S. S. Baghel, learned Dy. Govt. Advocate appearing for the respondent/ State.

“It is therefore most respectfully prayed that this Hon'ble Court may kindly be pleased to allow the petition & quash the impugned FIR & entire criminal proceedings initiated against the petitioner pursuant to impugned FIR bearing crime No. 43/2021 for the o+ences punishable U/s 374, 376(2)(n) of I.P.C at P.S. – Karpawand, Dist: Bastar (CG), in the interest of justice accordignly.”
3. At the very outset, learned counsel for the petitioner would submit that the trial is in progress and statements of some of the prosecution witnesses have been recorded, therefore, we are not inclined to entertain the present petition to which learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to take appropriate recourse to law, if cause of action arises in future.
4. Learned State counsel has no objection.
5. In view of the submissions made by learned counsel for the petitioner and also considering the fact that the victim has also not been impleaded as a party in the present case, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for.
6. Certi6ed copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same.
