Cdunserfor the Petitioner Counsel for the Respondent : Sri K.V.S.S.Prabhakara Rao The Court made the following: ORDER: : Assistant Public Prosecutor I.A.No.01 of 2025 The respondent is present. This Court, by order dated 14.08.2025 in Crl.P.No.7733 of 2025, declined to grant pre-arrest bail to the petitioner, directed him to surrender before the learned Jurisdictional Magistrate. However, no time limit was prescribed for such surrender. Without being aware of the said order, the police inadvertently arrested the petitioner on 18.08.2025 and produced him before the learned Jurisdictional Magistrate. The learned Magistrate refused to remand the petitioner to judicial custody and directed the Investigating Officer to file a copy of the order of this Court, granting three days’ time on or before 21.08.2025. On 21.08.2025, the petitioner filed a copy of the order of this Court before the learned Magistrate. Upon perusal of the same, the learned Magistrate closed the docket proceedings. The learned counsel for the petitioner seeks two (02) weeks’ time for the petitioner to surrender before the learned Jurisdictional Magistrate concerned and to move an appropriate application for enlargement on bail. This Court had passed an order on 14.08.2025, and nearly seventy (70) days have elapsed since then. However, the petitioner has not chosen to surrender before the learned Jurisdictional Magistrate. Considering the facts and circumstances of the case, this Court deems it appropriate to grant one (01) week’s time to the petitioner to surrender before the learned Magistrate without fail. In view of the above, I.A.No.1 of 2025 is disposed of, directing the petitioner to surrender before the learned Jurisdictional Magistrate within a period of one (01) week from today and to move an appropriate application. In the event of faHure to surrender within the aforesaid period, the Investigating Officer is at liberty to proceed in accordance with law against the petitioner. Sd/- SHAIK MOHD.
