By means of this writ petition, petitioner has sought the following reliefs:- “i) quash/set aside the impugned judgment and order dated 29.11.2024 passed by the learned Court of Additional Commissioner, Kumaon Division, Nainital in Revenue Revision No. 33/2022-23 (54/2023-24) (C- 1044808407023) (Bhupendra Singh Vs State of Uttarakhand and another), Under section 333 of "The Uttar Pradesh Zamindari Abolition and Land Reforms Act, 1950" (hereinafter referred as the UPZA&LR Act, 1950), whereby the learned Additional Commissioner Kumaon Division Nainital was pleased to dismiss the aforesaid Revision preferred by the petitioner. (Annexure No. 08 to the writ petition). ii) Quash/set aside the impugned judgment and order dated 27.02.2019 passed by the Respondent No. 01 in Case No. 51/02, year 2015-16 (State of Uttarakhand Vs. Balwant Singh), whereby the learned Court below/Respondent No. 1 was pleased to cancel the Lease Deed executed in favor of the Respondent No. 02 in Khasra No. 77/1 (Area 0.1510 Hectare), Khasra No. 92/1 (Area 0.0960 Hectare), Khasra No. 271/1 (Area 0.2200 Hectare), Khasra No. 274/1 (Area 0.2970 Hectare), KhasraNo. 140/1 (Area 0.7860 Hectare), Total Area 1.5500 Hectare, in which the Respondent No. 02 was 2025:UHC:3636 a recorded Tenure Holder/ Bhumidhar in Shreni Vargh 1Kha, so far as it relates to Khasra No. 274/1, Area 0.2970 Hectare (Land in dispute). (Annexure No. 06 to the writ petition).” 4. After arguing for a while, Mr. M.K. Ray, learned counsel appearing for the petitioner seeks permission to withdraw the writ petition with liberty to petitioner to approach the appropriate forum for redressal of his grievance. 5. Accordingly, writ petition is dismissed as withdrawn, with the liberty as above.
