ORDER:
This Writ Petition under Article 226 of the Constitution of India, has been filed, by the Petitioners for the following relief: <.... to issue writ order or direction more particularly one in the nature of Mandamus declaring the action of the 3rd respondent in interfering with the peaceful possession and enjoyment of the petitioners over the land in Sy.No.53-2 to an extent of Ac.1.00 cents and Ac.0.88 cents, respectively situated at Haripuram Village, Rambilli Mandal, Anakapalli District and sought to be dispossessed at the instance of the 4th respondent is highly illegally, arbitrary, colourable exercise of the power, apart from violation of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the 3rd respondent not to interfere with the peaceful possession and enjoyment of the petitioners over the land in Sy.No.53-2 to an extent of Ac.1.00 cents and Ac.0.88 cents, respectively situated at Haripuram Village, Rambilli Mandal, Anakapalli District at the instance of the 4th respondent and pass ...=
At the time of hearing, learned counsel for the Petitioners would submit that respondent Police are interfering in the possession and enjoyment of the subject property.
Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions would submit that there are civil disputes between the Petitioners and unofficial respondent and that civil suits are also pending before the concerned civil Court and that respondent Police never interfered in the civil disputes between the parties and would submit that this Writ Petition may be
disposed of by passing appropriate orders.
In that view, the Writ Petition is disposed of. Respondent Police are
directed not to interfere in the civil disputes between the parties except following due process of law. No order as to costs. Pending applications, if any, shall stand closed.
