Virender Singh, Judge (Oral) By way of the present petition, indulgence of this Court has been sought to comply with the order dated 09.09.2024, passed by the Court of learned Additional Sessions Judge, Kinnaur at Rampur Bushahr (hereinafter referred to as the ‘First Appellate Court’), passed in Cr.MP No.743 of 2024, whereby the learned First Appellate Court has allowed the application, filed under Section 389 Cr.PC, by directing the petitioner to deposit 20% of the amount of compensation, 1 Whether Reporters of local papers may be allowed to see the judgment? Yes. 2 ( 2025:HHC:1646 ) before the learned trial Court and to furnish personal bond, in the sum of Rs.25,000/- with one surety in the like amount, to the satisfaction of learned trial Court, within a period of two months from the said date. 2. Admittedly, order dated 09.09.2024, passed by the learned First Appellate Court, has not been complied with. 3. Now, the indulgence of this Court has been sought, mainly, on the ground that there was exceptional hardship, on the part of the applicant, as, he was ill and suffering from dengue. In order to substantiate the said fact, the photocopies of the prescription slips, as well as, medical laboratory reports have also been annexed. 4. Considering the said fact, let order dated 9.9.2024, passed by the learned First Appellate Court be complied with, within a period of seven days from today, failing which, the respondent-complainant, is at liberty to execute the judgment of conviction and order of sentence, dated 09.08.2024, passed by the learned trial Court. 3 ( 2025:HHC:1646 ) With these observations, the petition is disposed of accordingly .
