GP FOR REVENUE The Court made the following: 3 Order: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondents in interfering with the petitioners’ peaceful possession and enjoyment of the agricultural land to an extent of Ac.0.72 cents each in Survey Number 227 of Mangamuru Revenue Village, Santhanuthalapadu Mandal, Prakasam District, for the allotment of house site pattas to the weaker section people under the Navaratnalu–Pedalandariki Illu scheme. 3. On the other hand, the learned Assistant Government Pleader, relying upon the counter of the 4th respondent, submits that the subject land is a Government land and the petitioners are not in possession of the same in the revenue records to show their right in the subject land and it is filled with boulders and was never cultivated by the petitioners. 4. In view of the above said facts and circumstances, no relief can be granted to the petitioners. However, the respondent Nos.2 to 4 are directed to deal with the subject land to an extent of Ac.0.72 cents as claimed by the petitioners in Sy.No.227 of Mangamuru Revenue Village, Santhanuthalapadu Mandal, Prakasam District, strictly in accordance with law if so warranted for any public purpose and if the petitioners are otherwise found to be in possession of the same, they shall not be dispossessed from the subject land except by following the due process of law, giving due opportunity of hearing 4 to all the parties concerned including the petitioners, and upon verification of the records and the subject land, an appropriate decision shall be taken on its own merits. 5. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. Interim orders, if any, stands vacated.
