Neutral Citation No. - 2025:AHC:63525 Court No. - 6 Case :- WRIT - A No. - 9708 of 2014 Petitioner :- Pragti Kumari Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Hritudhwaj Pratap Sahi,K.Shahi,Sankalp Narain,Saurabh Singh,Vikas Budhwar Counsel for Respondent :- Amit Saxena,K.Shahi,Vikram Bahadur Singh Hon'ble Saurabh Shyam Shamshery,J.
1. Heard Sri V.K.Singh, learned Senior Counsel assisted by Sri Abhishek Kushwaha, learned counsel for the petitioner and Sri Saurabh Singh for respondent no.4.
2. Petitioner has himself invited trouble since her brother has also applied for compassionate appointment as their father died in harness on 11.9.2010 and due to said dispute by way of impugned
order dated 14.5.2013 claim of the petitioner was rejected that it will be granted on basis of succession certificate.
3. There is a substance in the argument of learned Senior Counsel that ground given in the impugned order that she ought to have come up with NOC of other claimant or vice versa was not considered and Basic Shiksha Adhikari may have decided the issue on basis of eligibility, however, it was no done.
4. Learned counsel for the respondent no.4 submitted that all the benefits have been received by the petitioner.
5. Father of the petitioner died in harness way back in the year 2010 i.e. about 15 years and this writ petition is pending for last more than 11 years.
6. As reiterated by Supreme Court in the case of Malaya Nanda Shetty vs. State of Orrisa and others, 2022 SCC Online SC 684, object to grant compassionate appointment is to tide over the immediate financial crisis as well as other crisis, which does not exist at this belated stage.
7. A rightful claim of the petitioner or the respondent no.4 is lost
due to a dispute between them and the Court cannot rescue or solve their disputes at this belated stage.
8. Accordingly, this writ petition is dismissed.
