Neutral Citation No. - 2025:AHC:73220 Court No. - 1 Case :- CONTEMPT APPLICATION (CIVIL) No. - 5839 of 2021 Applicant :- Vimal Kumar And Another Opposite Party :- Ranvir Singh And 5 Others Counsel for Applicant :- Surendra Pratap Singh Counsel for Opposite Party :- Sandeep Kumar Hon'ble Salil Kumar Rai,J. Heard the counsel for the applicants. The present contempt application has been filed pleading willful disobedience of the orders dated 15.10.1998 and 4.2.1999 passed by this Court in Civil Misc. Writ Petition No. 33033 of 1998. By order dated 15.10.1998, this Court directed that till 3.12.1998, the parties will maintain status-quo with regard to the possession over the land in dispute. The interim order was extended till further orders by order dated 4.2.1999 passed by this Court. It has been alleged in the contempt application that in violation of the orders passed by this Court, the opposite parties have executed a sale deed on 25.11.2021. Mere execution of sale deed by itself is not sufficient to register proceedings in contempt in view of Section 13(a) of the Contempt of Courts Act, 1971. Apart from the aforesaid, the order dated 15.10.1998 did not prohibit the opposite parties from executing any sale deed. The validity of the sale deed would be dependent on the decision of the writ petition. The contempt application is disposed of. Notices are discharged. The Registrar General of the Court is directed to refund the amount deposited by the opposite parties in this Court in pursuance to the order dated 18.5.2022 within one week from today. The amount shall be credited in the account of the depositors within the next one week. Order Date :- 7.5.2025 Satyam Digitally signed by :- SATYAM AGRAHARI High Court of Judicature at Allahabad
