No one turns up on behalf of either of the parties in-spite of repeated calls.
Apprehending their arrest in connection with Gonda P.S. Case No.38 of 2024 instituted under Sections 147, 148, 149, 307, 324, 323, 325 and 326 of the Indian Penal Code, the petitioners have moved this Court for grant of privileges of anticipatory bail.
Perusal of the record reveals that the allegation against the petitioners is that the petitioners were the member of unlawful assembly and being armed with lathi and danda assaulted the informant causing injuries. It has been averred in the brief that petitioners are innocent and there is inordinate delay of more than 24 hours in lodging of the F.I.R. It is averred that nature of injury sustained by the alleged victim has not been mentioned anywhere. It is further averred in the anticipatory bail application that the allegations against the petitioners are false. It is next averred in the anticipatory bail application that the petitioners have no criminal antecedent as mentioned in paragraph no.14 of the anticipatory bail application. It is also averred in the anticipatory bail application that the petitioners are ready and willing to abide by any terms and condition as imposed by this Court.
Considering the aforesaid facts of the case, I am inclined to grant privileges of anticipatory bail to the petitioners. Accordingly, the petitioners are directed to surrender in the Court below within six weeks from today
and in the event of their arrest or surrendering, they will be enlarged on bail on depositing Rs.10,000/- each as cash security and on furnishing bail bond of Rs.25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ranchi in connection with Gonda P.S. Case No.38 of 2024 with the condition that they will co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish their mobile number and photocopy of the Aadhar Card with an undertaking they will not change their mobile number during the pendency of the case and they will not annoy or disturb the informant in any manner during the pendency of the case and further conditions as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
