1. The petitioner says that he is in custody for 161 day. Investigation is complete. There was no seizure of booty from him. He prays for bail. 2. Learned State advocate draws our attention to the material in the Case Diary. 3. Learned State advocate says that Call Details Report would show that at the relevant time, calls were exchanged between the petitioner and other accused persons. 2 antecedents. The petitioner says that he has not suffered any conviction till date. 4. We have seen the seizure list and statements of witnesses. Prima facie, there does not appear to be any recovery from this petitioner. On an overall assessment of the material on record, we are of the view that further custodial detention of the petitioner is not necessary. 5. Accordingly, we direct that the petitioner, namely, Nowsad Ali @ Nausad Ali @ Naowar Ali @ Naosad Ali @ Gedu, shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand), with two sureties of like amount each, one of whom must be local, to the satisfaction of learned Additional Chief Judicial Magistrate, Ranaghat. The petitioner shall appear before the trial Court on every date of hearing and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever and shall not also commit any cognizable offence in any manner whatsoever.
The petitioner shall not enter the jurisdiction of Ranaghat Police Station except for the purpose of attending the court proceedings, until further orders and shall appear before the Officer-in-Charge/Inspector-in-Charge of Santipur Police Station once in a week, until further orders. The petitioner shall not run any jewellery business, until further orders. 6. In the event the petitioner fails to comply with any of the conditions stipulated above, the trial Court shall be at liberty to cancel the bail in accordance with law without further reference to this Court. 7.
