1. State Of Rajasthan, Through Public Prosecutor. 2. The Director General Of Police, Rajasthan Police Head Quarter, Lalkothi, Jaipur. 3. Superintendent Of Police, Ajmer. 4. Station Head Officer, Police Station Gandhi Nagar, District Ajmer. 5. Station Head Officer, Police Station Madanganj, District Ajmer. ----Respondents For Petitioner(s) : Mr. Devanshu Sharma Ms. Vishalakshi Pareek For Respondent(s) : Mr. Amit Punia, PP JUSTICE ANOOP KUMAR DHAND Order 30/10/2025
1. By way of filing this criminal misc. petition, a prayer has been made for issuing directions to the respondents to club all the FIRs registered against the petitioner with Police Station Gandhi Nagar, Ajmer and Madan Ganj, Ajmer. 2. At the outset, learned Public Prosecutor apprised this Court that with regard to the same prayer, the petitioner approached this Court on earlier occasion also by way of filing S.B. Criminal Misc. Petition No.5705/2025. He submits that the aforesaid misc. petition was withdrawn by the petitioner on 16.09.2025 with
[2025:RJ-JP:43551] (2 of 3) [CRLMP-6610/2025] liberty to file a representation before the concerned Superintendent of Police, Ajmer. Learned counsel submits that the petitioner has submitted a representation on 20.09.2025, but till date the same has not been decided and no adverse order has been passed against the petitioner, hence under these circumstances, no cause of action has arisen with the petitioner to approach this Court again with regard to the same prayer, which was made in the earlier misc. Petition, hence, the petition is liable to be rejected. 3. Heard and considered the submissions made at the Bar and perused the material available on the record. 4. Considering the arguments put forward by learned Public Prosecutor and looking to the fact that with regard to the similar prayer, the petitioner approached this Court by way of filing S.B. Criminal Misc. Petition No.5705/2025 and the same was withdrawn by him vide order dated 16.09.2025 with liberty to file a representation before the concerned Superintendent of Police, Ajmer. 5. It appears that pursuant to the aforesaid directions, the petitioner has approached the office of Superintendent of Police, Ajmer by way of filing representation on 20.09.2025.
It also appears that till date, the said representation has not been decided and the same is still lying pending for its adjudication on its merits. 6. In the considered opinion of this Court, the successive misc. Petition with regard to the same prayer is not maintainable as the matter is still subjudice before the concerned Superintendent of Police. [2025:RJ-JP:43551] (3 of 3) [CRLMP-6610/2025]
7. In the fitness of facts and circumstances of the case, this Court deem it just and proper to dispose of the instant misc. petition by issuing directions to the Superintendent of Police, Ajmer to decide the representation submitted by the petitioner (pending, if any), expeditiously as early as possible, preferably within a period of four weeks from the date of receipt of certified copy of this order by passing a reasoned and speaking order. 8. Accordingly, this criminal misc. petition stands disposed of. Stay application as well as all applications (pending, if any) also stand disposed of. (ANOOP KUMAR DHAND),J Karan/47
