V V SATISH (SC for APEPDCL) The Court made the following: ORAL ORDER: Heard Sri Ravi Teja Dommeti, learned Counsel for the Writ Petitioner, Sri Panuku Rajesh Kumar, learned Assistant Government Pleader for Finance & Planning, Ms. Kothapalli Aishwarya Chowdary, learned Counsel representing Sri V.V. Satish, learned Standing Counsel for A.P.E.P.D.C.L., and Sri Y. Koteswara Rao, learned Standing Counsel for Gram Panchayat. 2. The Prayer sought in the present Writ Petition is as under: “It is therefore prayed that this Honourable Court may be pleased to issue a Writ, Order, or Direction, more particularly one in the nature of Mandamus, declaring the action of the respondents in not issuing NOC and rejecting the application No. NSCREG03441482 dated 04-06-2025 for new LT commercial service connection without notice or valid reasons, as arbitrary, illegal and violative of Articles 14 and 21 of the Constitution of India and Consequently, direct the respondents to process and sanction the said LT Commercial service connection at the petitioners premises, by setting-aside the 3rd and 4th respondents’ Rejection Orders, within a time-bound manner and Pass such other order or orders as may be deemed just and proper in the circumstances of the case. It is further humbly prayed that this Honourable Court may be please to direct the 4th Respondent to Install temporary electric meter with required Power Supply, pending disposal of the Writ Petition and Pass such other order or orders as may be deemed just and proper in the circumstances of the case.” 3. Learned Counsel for the Writ Petitioner has drawn the attention of this Court to the Order dated 11.07.2025 passed by the Panchayat Secretary, Gorlivanipalem Gram Panchayat indicating that the request of the Writ Petitioner cannot be considered due to the pendency of W.P.No.7845 of 2025. 4. Learned Counsel for the Writ Petitioner has also drawn the attention of this Court to the Order passed by this Court on 09.07.2025 (Ex.P.5) in W.P.No.7845 of 2025, which indicates that the Petitioners therein have withdrawn the said Writ Petition. It is submitted that the Writ Petitioners in W.P.No.7845 of 2025 were not parties in the present Writ Petition. 5. Learned Counsel for the Writ Petitioner further submits that in view of the withdrawal of W.P.No.7845 of 2025 on 09.07.2025, there is no impediment on the Panchayat Secretary, Gorlivanipalem Gram Panchayat in considering the Application of the Petitioner and passing an appropriate Order in accordance with law. 6. Having considered the above facts, this Court deems it appropriate to dispose of this Writ Petition at the admission stage without going into the merit, directing the Panchayat Secretary, Gorlivanipalem Gram Panchayat to consider the Application of the Writ Petitioner and pass a Speaking Order in accordance with law and convey the same forthwith to the Writ Petitioner within a period of three (03) weeks from today. 7. Sri Y. Koteswara Rao, learned Standing Counsel for Gram Panchayat appearing for Respondent No. 3, is directed to convey the gist of this Order to Panchayat Secretary, Gorlivanipalem Gram Panchayat (Respondent No.3) forthwith for effective compliance. 8. Writ Petitioner is also directed to submit a photocopy of the Application submitted by him on 04.06.2025 to Panchayat Secretary, Gorlivanipalem Gram Panchayat (Respondent No.3) within one week from today for effective compliance. 9. With these observations and directions, the Writ Petition is disposed of. 10.
