The petitioner has been appointed as a Trainer in Classical Karnatic Music on contract basis for a period of one year vide proceedings dated 16.09.2011. The learned counsel for the petitioner submits that the respondents have issued proceedings dated 01.05.2012 dispensing the service of the petitioner. 2. It is submitted by the learned counsel for the petitioner that the proceedings dated 16.09.2011 are issued to the petitioner appointing the petitioner as a Trainer in Classical Karnatic Music and that the said proceedings are referred to the applicability of statutes, ordinances, rules and regulations of the respondent/univefsity. It is submitted that no such rules were framed to regulate the appointment of the petitioner and the same was elicited from the respondents by the petitioner by filing a petition under RTI Act. It is submitted that the petitioner was not entrusted duties nor there was any said procedure formulated assigning either the duties or recording of attendance of the any 3 petitioner. In this regard, the petitioner made several representations to the respondent seeking the intervention of the concerned for framing of rules of service of the petitioner. Though the petitioner submitted representation dated 08.12.2011 followed by representation dated 15.12.2011 and representation dated 09.01.2012. The respondents have not responded to the petitioner’s representations, however vide proceedings dated 01.05.2012, the petitioner has been relieved from duties with effect from 01.05.2012. 3. The learned counsel for the petitioner seeks a direction from this Court to set aside the proceedings dated 30.04.2012 and consequently to direct the respondent to appoint the petitioner to the post of Assistant professor and extend UGC Scales. 4. The respondents in their counter submit that the petitioner was considered for appointment as Music Trainer contract basis and consolidated pay and in that regard the orders of appointment of dated 16.09.2011 have been issued. It is also submitted that the petitioner has accepted the letter of offer and joined the service. The petitioner on was 4 aware of the terms of appointment and cannot claim any right claim services rendered in respondent/university. 5. It is also submitted that the petitioner was irregular to his job and that the petitioner cannot have any right to claim services rendered in the respondent in any form. It is submitted that the respondent/university based on involving the mix of video lectures and conditional lab practice. The video lectures are as per the faculty plan. 6. It is also submitted that the petitioner cannot claim for absorption as a matter of fundamental right, it is also submitted that the petitioner has also been selected as a supporting staff to the Teaching faculty. 7. Considering the submissions, this Court finds no grounds to interfere with the impugned proceedings as the petitioner was recruited on contract basis for a specific period of time and the petitioner served from 16.09.2011 to 30.04.2012. The period of contract for a period of one year. Considering the stand taken by the respondent, the petitioner cannot be granted any relief as sought for in the present writ petition. 8. In the result, the writ petition is dismissed.
