ORDER :
The present writ petition is filed under Article 226 of the Constitution of India seeking the following relief: <…declaring the action of the respondents in withholding the payments that are payable to the petitioner for the work of providing terminal distribution network through sumps, pumping system, pipe lines and Micro Irrigation System in canal command areas of Lingala canal system Micro-Block-2 for an amount of 2,46,215/- (Forty Two Lakhs Forty Six Thousand Two Hundred and Fifteen Only) for the work of providing terminal distribution network through sumps, pumping system, pipe lines and Micro Irrigation System in canal command areas of Lingala canal system Micro-Block-2as illegal arbitrary and violative of Article 14, 19(1)(g), 21 and 300-A of the Constitution of India and consequently direct the respondents to release the payments for an amount of 42,46,215/- ( Forty Two Lakhs Forty Six Thousand Two Hundred and Fifteen Only) along with 6percent interest with in a time bound period=. 2. The petitioner is a company engaged in execution of Irrigation projects and it was awarded the work of “Providing terminal distribution network through sumps, pumping systems, pipelines, and Micro Irrigation system in canal command areas of Lingala Canal System – Micro Block-2 for 2500 acres, vide Agreement No.36SE/2008-09 dated 11.02.2009. Originally, the said work was sanctioned for an amount of Rs.8,45,22,495/- under G.O.No.220 dated 17.11.2008, but due to various reasons, the said work could not be completed within the stipulated time, and time for execution of the work was extended up to 30.05.2015. However, as per the Supplemental Agreement No.43SE/2022-23, dated 11.01.2023, the petitioner executed the said executed work to a tune of Rs.5,52,23,908/- as against the value of Rs.8,45,22,495/-. Despite the petitioner company completed the work as per

the supplemental agreement, the respondent authorities failed to release pending dues of Rs.42,46,215/- for the execution of the work. Aggrieved by the action of the respondents in not releasing the pending dues, the present writ petition came to be filed. 3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Irrigation. 4.
Today, when the matter taken up for hearing, the learned Assistant Government Pleader placed on record a copy of the instructions given by the Executive Engineer, NTR TGP Division No.1, Kadapa, in Lr.No.EE/NTRTGP Div.No.1/KDP/DB/AEE/Court case/387M, dated 10.09.2025, wherein it is stated that the bill was scrutinized and processed for submitting the bill in CFMS Portal also as per CFMS Phase-II module, budget is required for submitting the bill in CFMS portal and that a letter was submitted to the Superintending Engineer, SKD GNSS Project Circle, Kadapa, vide Lr.No.EE/ NTR TGP Div.No.1/KDP/AB/EC.1/BRO File/38SE GNSS, dated 13.03.2024 and requested for obtaining the budget release order from the competent authority for Rs.42,46,215/-. It is further stated that recently, in the place of CFMS Phase-II, NIDHI portal is implemented for uploading work bills, and it requires migration of legacy works bills data to from CFMS Phase-II to NIDHI portal and it requires scrutiny at maker, checker and approver levels. Further, budget release order from the competent authority is required for uploading the bill in NIDHI portal and it may take period of Four (4) months for

completion of the above said works in NIDHI portal. However, bill for releasing the withheld amounts is under process to upload in NIDHI portal and after obtaining necessary approvals the bill will be uploaded in NIDHI portal. 6. Having regard to the facts and circumstances of the case, in view of the fact that the respondents are ready to pay the admitted amount of Rs.42,46,215/- and the budget for releasing the said amount is under process, keeping the writ petition pending, this court feels it appropriate to dispose of the writ petition by directing the respondents to pay the amount soon after release of the amount. 7. Accordingly, the writ petition is disposed of and the respondents are
directed to pay the admitted amount of Rs.42,46,215/- soon after release of the budget, to the petitioner as expeditiously as possible, preferably within a period of four (4) months from the date of receipt of a copy of the order. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. _____________
