1. The petitioner is aggrieved by the inaction on the part of respondent authorities in issuing TDR bonds for the land acquired.
In that regard, the petitioner submitted representations dated 11.08.2025, 07.07.2025 and 23.03.2025 and 02.09.2024. 2. It is submitted that the land admeasuring 25 ankanams belonging to the petitioner was acquired by the respondent authorities. It is further submitted that the property stands in the name of the petitioner’s mother, Narayanamma, who purchased the same vide registered sale deed bearing No.3359/1982. 3. It is submitted that the said property, along with other properties, was acquired by the 2nd respondent through respondent Nos.1 and 3 for better performance of public works. However, the petitioner was not issued TDR bonds, though several other affected landowners were issued TDR bonds. The petitioner was denied TDR bonds for the reasons best known to respondent No.3. 4. This Court requested the learned Standing counsel to ascertain the extent of land belonging to the petitioner that was acquired for public purposes. On written instructions, the learned Standing counsel submits that the respondent authorities are willing to issue TDR bonds, subject to the petitioner submitting the ownership document and a family member certificate. Having acquired the said property from her mother, the petitioner is called upon to submit a fresh family member certificate and a copy of the registered gift deed, registered will, or
4 HN, J W.P.No.22707_2025 unregistered will to the office of the 3rd respondent for taking necessary action for issuance of TDR bonds. 5. The learned counsel for the petitioner submits that the petitioner succeeded to the property, and that the petitioner submitted a valid family member certificate. It is also submitted that the petitioner is in possession and enjoyment of the remaining extent of the property. 6. Considering the same, the endorsement dated 19.08.2025 shall be complied by the petitioner by submitting a family member certificate to the 3rd respondent, and the 3rd respondent shall issue TDR bonds after verification of the said documents within a period of eight (08) weeks from the date of submission of such certificate. 7. Accordingly, the writ petition is disposed off. There shall be no order as to costs.
