AGP Ms. Sunita Shaw Mr. Soumen Chatterjee … for the State-respondent(s) The petitioner is aggrieved by the fact that he has been thrown out from his residence on or about 01.02.2024. The foundation of such allegation of being thrown out as is contended in the writ petition happens to be a relation of the petitioner having been involved in a criminal case. State has submitted a report, which, in fact, is in tune with the facts stated by the petitioner, particularly, the outrage which resulted on the petitioner of 2 being thrown out from his house/residence and the alleged offence, which resulted in English Bazar P.S. Case No. 143 of 2024 dated 29.01.2024. The report also reflects that the petitioner filed an application under Section 156(3) of the Cr.P.C., pursuant to which English Bazar P.S. Case No. 611 of 2024 dated 14.05.2024 was registered for investigation. The investigation of the said case is still in progress. The petitioner, presently, contends that he is unable to enter his residence and prays for police assistance. In case, the police authorities are of the opinion that the premises referred to in the writ petition belongs to the petitioner and the petitioner is unable to stay and/or enter at his house/residence because of the consequences of the criminal case having been registered against another person 3 with which the petitioner is not associated, in that case, the police authorities would render all possible assistance as also provide proper escort for entering the petitioner into/at his residence/house. In case, there is any public law and order crisis pursuant to the petitioner entering his residence/house, the police authorities would take stern steps. The police authorities would also keep a strict vigil and ensure that no breach of peace and tranquility takes place as also no untoward incident results after the petitioner is allowed to enter his residence/house. With the aforesaid observations, WPA 30753 of 2024 is disposed of. Report so submitted be kept with the record.
