The Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioners/accused Nos.1, 2, 4, 5 & 6 to grant anticipatory bail in connection with Crime No.248 of 2024 of Pedavegi Police Station, Eluru District. 2. A case has been registered against the petitioners/accused Nos. 1, 2, 4, 5 & 6 and another for the offences punishable under 2 Sections 341, 324, 506 read with 34 IPC and Sections 3(1)(r), 3(1)(s) of the SCs & STs (PoA) Act. 3. Case of the prosecution is that, on 20.06.2024, the de-facto complainant lodged a report stating that on 19.06.2024 at 11.30 p.m., he, along with his friends, was going to Vanguru Village on motor cycle. On reaching near Polavaram right canal, Lakshmipuram Village, in view of the previous disputes, the accused persons obstructed the de-facto complainant. They allegedly abused the de-facto complainant using filthy language referring his caste and further threatened to kill him 4. A perusal of the material available on record, it is apparent that the primary accusation against the accused is that the accused allegedly abused the defacto complainant in the name of his caste. In such circumstances, the question of maintainability of the Criminal Petition seeking anticipatory bail itself would not arise. 5. In view of the aforesaid facts and circumstances, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending, shall stand closed. _____________________________ JUSTICE K.
