Order on Board 15/09/2025
1. With the consent of the parties the matter is heard finally.
2. By the present writ petition, the petitioner is seeking direction to the respondent authorities to activate/unhold of the account of the petitioner bearing A/c No.40522015041, SBI Sarangarh. The petitioner is a widow of Late Basant Lal, an employee of CCL and all life time incomes were deposited in a joint account (No. 11471754278) of the petitioner and her husband with SBI, Bokaro (Jharkhand). 2 Unfortunately the husband of petitioner died on 28.05.2021, the petitioner being the sole nominee and lawful wife, transferred the amount to her personal savings account (No. 40522015041). Subsequently, when the petitioner shifted to Sarangarh, the said account was transferred From Bokaro Branch to SBI Sarangarh Branch. Shockingly, the account was suddenly put on hold/frozen by the bank without any notice or lawful justification. As a result, the petitioner has been deprived of her pension and other monetary dues, leading to severe financial hardship. Despite repeated representations and submission of all relevant documents (death certificate, passbooks, nominee papers, ID proof), the respondents have neither lifted the freeze nor disclosed the reasons. The action is arbitrary, violative of RBI guidelines, principles of natural justice, and fundamental rights under Articles 14 & 21 of the Constitution.
3.
Learned counsel for the respondent-Bank on advance copy, supported the impugned order and prays for dismissal of the petition.
4. I have heard learned counsel for the parties and perused the documents.
5. Considering the facts and circumstances of the case, particularly the fact that there is dispute between the legal heirs of the first wife and second wife of the deceased and the facts of the present case are all disputed facts, which are required to be adjudicated by the competent Civil Court, as such writ petition is not maintainable and deserves to be dismissed.
6. However, liberty is granted to the petitioner to take recourse of civil law as available to her. Learned counsel for the respondent-Bank is Digitally signed by JYOTI JHA Date: 2025.09.16 10:51:16 +0530

directed to provide all the documents to the petitioner related to the petitioner which are in possession of the respondent-Bank within 30 days from the date of receipt of copy of this order.
