This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the application dated 10.09.2024 in case crime no.269 of 2022 under Sections 406, 504, 506 I.P.C., Police Station- Lalganj, District- Basti pending in the Court of learned Chief Judicial Magistrate, Basti expeditiously within stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. Applicant before this Court is the accused as he was a chronic absconder punitive process under Section 82/83 Cr.P.C. were issued against him and his property was attached by the order of the Court and now the present application has been filed to decide expeditiously an application moved by the applicant/ accused for release of his domestic articles which were attached by the police. 4. However, the Court takes notice of the fact that earlier an Application U/S 482 Cr.P.C. No. 27808 of 2024 was moved by the present applicant wherein an order was passed by the co-ordinate Bench of this Court to stay the further proceedings of the instant criminal case until further orders of this Court vide order dated 5.9.2024. Since the proceedings of this case are stayed no application can be entertained by the Court concerned. 5. In these circumstances, there is no justification to issue any direction to the trial Court for expeditious disposal of the release application moved by the accused applicant. 6. With the above observations, the application stands disposed of.
