Present applicant-Vijay Kumar Tamta is praying for regular bail in relation to FIR dated 09.10.2024 registered as FIR No. 193 of 2024 whereby the applicant has been implicated for the offences punishable under Sections 179, 180, 238 of BNS 2023 at P.S. Lalkuan District Nainital. 4. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated and furthermore he is not named in the FIR. Apart from this, he submits that other co-accused who had given the similar role has already been enlarged on bail by this Court on 22.04.2025. 5. Mr. V.S. Pal, learned A.G.A. has not disputed this fact that the role of the applicant is identical to Ali Mohammad who was enlarged on bail, and as such, he is entitled to get the benefit of the parity. 6. After hearing the learned counsel for the parties and further taking into consideration that other co-accused is already enlarged on bail, this Court is of the view that the applicant deserves for bail. 7. Accordingly, Without expressing any opinion on the merits of the case, the bail application is allowed. 8. Let the application Vijay Kumar Tamta be released on bail on his 2025:UHC:3067 executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
