Heard learned counsel for the parties and perused the record. 2. This writ petition has been filed for following relief:- "a. Issue a writ, order or direction, in the nature of MANDAMUS directing the Additional Commissioner Judicial First Varanasi Division Varanasi/respondent No.2 to decide the appeal No.C202514000000244 of 2025 Nayyar Alam Vs. Ashfaq Ahmad) under section 207 of U.P. Revenue Code 2006 as to the well as the stay application dated 13.01.2025 filed by the petitioner within stipulated period, otherwise it will be irreparable loss and injury to the petitioner." 3. Contention of learned counsel for the petitioner is that appeal as well as the stay application filed in the appeal are pending since 13.01.2025 and he prayed that the same may be decided expeditiously. 4. No useful purpose would be served in keeping this petition pending. 5. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to respondent No.2 -Additional Commissioner (Judicial), First, Varanasi Division, Varanasi to consider and decide the stay application filed in the appeal, in accordance with law, expeditiously, preferably within a period of twelve weeks from the date of production of a certified copy of this order after ensuring service upon all the parties, giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided there is no other legal impediment.
