No.628 of 2024, whereby relief has been accorded to him in respect of the request for transfer in terms of extant policy. 2. This matter was heard at length already and Court had indicated its red eye in view of blatant discriminatory treatment of the employees contributing one homogenous clause under the policy. At this stage learned Senior Panel Counsel appearing for the ESIC took time to confer with his client and come back. Accordingly, he has come back with a memo dated 09.02.2026 which reads as under: “The writ petition has been filed challenging the order of learned CAT, Cuttack bench dated 04.04.2025. The petitioner, has implemented the said direction on 06.02.2025, a copy of which is enclosed herewith. Therefore, the petitioner prays to permit him to withdraw the writ petition since it has been rendered infructuous. Order No. 05. The above memo is accompanied by office order No.4 of Year 2026 dated 06.02.2026, which reads as under: “In accordance with the judgment dated 04.04.2025 passed by the Hon’ble Central Administrative Tribunal (CAT), Cuttack Bench in O.A. No.628/2024, and in light of the oral observations made by the Hon’ble High Court of Orissa in WPC No.25016/2025 (as communicated vide Regional Director, Odisha Letter No. 44-C.P No.51/2025 dated 05.02.2026, based on the report of the Legal Counsel, Regional Office Odisha), the Director General, Employees’ State Insurance Corporation has ordered the Inter-Region Transfer (IRT) of the following employee with immediate effect.
