Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the 3rd respondent in not considering the petitioners’ Appeal dated 04.03.2020 challenging the proceedings in R.C.No.B.100/2019, dated 28.11.2019, passed by the 4th respondent. 3. The grievance of the petitioners is that the Appeal pending before the 3rd respondent has not been disposed of till now. Hence, this writ petition. 4. On the other hand, the learned Assistant Government Pleader, relying upon the written instructions of the Revenue Divisional Officer, Eluru, dated 15.09.2025, submits that in view of the bifurcation of the Revenue Districts, the Appeal file was transferred from the 3rd respondent to the Revenue Divisional Officer, Eluru, and the same is pending on its file. Since the said authority is not a party to this writ petition, this Court suo motu impleaded him as the 5th respondent in this writ petition as well as in the pending I.As. The Registry is directed to carry out the necessary amendment in the cause title. 5.
In view of the above said facts and circumstances, the 5th respondent i.e., Revenue Divisional Officer, Eluru, is directed to dispose of the Appeal filed by the petitioners dated 04.03.2020 against the orders of the 4th respondent dated 28.11.2019, strictly in accordance with law, by hearing all the parties concerned including the petitioners, giving due opportunity, and

upon verification of the records and the subject land, an appropriate decision shall be taken on its own merits within a period of three (03) months from the date of receipt of copy of this order. 6. The copy of the written instructions of the Revenue Divisional Officer, Eluru, dated 15.09.2025, shall be made as part of the Court record. 7. Accordingly, this Writ Petition is disposed of. Interim order, if any, is deemed to have been vacated. There shall be no order as to costs.
