GP FOR REVENUE 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 22884 of 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: <…to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents particularly the 5th respondent and taking assistance of 6th respondent in interfering in petitioner peaceful possession and enjoyment over his agricultural landed property admeasuring with an extent of Ac.1.00 cents covered by survey No. 73/6 situated in A.S Peta of Ichapuram Mandal in Srikakulam District and declare the same as illegal, irregular and irrational, without there being any authority or sanction of law and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents 5 and 6 not to interfere in any manner with petitioner peaceful possession and enjoyment over the said agricultural landed property and with his personal life and liberty …= 2. Heard Sri Ala Chandrasekhar Yadav, learned counsel for the petitioner and Sri P.Ajay Babu, learned Assistant Government Pleader for Home, for the respondents. 3. Learned counsel for the petitioner would submit that the respondent- police are interfering in the peaceful possession and enjoyment of the petitioner’s property without there being any authority or sanction of law. 4. Learned Assistant Government Pleader for Home, on written instructions would submit that the respondent-police never interfered in the civil disputes as alleged by the petitioner. The police also did not receive any letters of instructions for assistance. 4 5. Recording the same, this Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties, except under due process of law. No order as to costs.
