IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C) NO.21468 OF 2025 Satya Ranjan Mohanta …. Petitioner Mr. R. N. Mishra, Advocate -versus- State of Odisha & Others …. Opp.Parties Mr. U.C. Behura, AGA CORAM: HON’BLE MR. JUSTICE DIXIT KRISHNA SHRIPAD ORDER Order No. 02. 14.08.2025 Petitioner has scripted the original prayer as under: “It is, therefore, most humbly prayed that this Hon'ble court may graciously be pleased to issue writ in the nature of writ of mandamus or any other appropriate writ/direction/order, by quashing the impugned order under Annexure-17. And the Hon’ble Court be further pleased to direct the Opp.Parties, more specifically the Opp.party No.5 to allow the petitioner to join duty with payment of arrear salary and thereafter to proceed to conclude the DP in accordance with the direction as under Annexure- 7 & 8 by giving opportunity to the petitioner to defend in accordance with the principle of Natural Justice.” 2. An application is moved seeking to add additional prayer for laying a challenge to the dismissal order dated 28.07.2025 by way of amendment under the shadow of this Court’s order dated 05.08.2025. 3. Learned AGA-Mr. Behura appearing for the OPs points out that the order of dismissal is statutorily appealable before the Director and, therefore, Petitioner should be relegated to the alternate and equally efficacious remedy. Learned counsel for the Petitioner is agreeable to this proposal, provided that liberty is reserved to him to file appeal within two weeks coupled with a direction to the Director to dispose off the appeal within an outer limit of eight weeks. This is a happy thing to happen in writ jurisdiction. In the above circumstances, writ petition is disposed off reserving liberty to the Petitioner to avail the alternate remedy of appeal within two weeks reckoned from this day and if appeal is filed, the appellate authority shall hear and dispose off the same and inform result of such disposal to the Petitioner within an outer limit of eight weeks. All contentions of the parties are kept open. Now, no costs. Web copy of this order to be acted upon by all concerned. (Dixit Krishna Shripad) Judge Madhusmita
