Order: The Criminal Petition, u/Sec.482 of B.N.S.S is filed on behalf of the petitioner/accused to grant anticipatory bail in connection with Crime No. 157/2025 of Prohibition & Excise Station, Rajamahenravaram South, East Godavari District.
2. A case has been registered against the petitioner/accused for the offences punishable under Sections 7(B) r/w 8-A of A.P.Prohibition (Amended) Act, 2020.
3. The brief facts of the case are that on 17.03.2025 at 11.00 p.m., on credible information, the Prohibition Excise Inspector along with staff and mediators reached at the Lemon and Cashew Mango Garden in front of RIET College, Bhupalapatnam Village of Rajanagaram Mandal found one person standing infront of the hearth and stirring with stick in the top vessel which was kept on the hearth. On seeing the raid party the person ran away from the scene of offence, but the raid party identified the ran away person and called his name but the person turn his head back once and did not stop and ran away from the scene of offence. Then the raid party found FJ wash 800 liters in drums, which was fit for distillation of ID liquor.
2 Hence, the police seized the id liquor in the presence of mediators and registered the case.
Learned counsel for the petitioner submits that, based on the mediators report, the crime was registered against petitioner/accused. Except mediators report, no other independent material has been collected to show the involvement of the petitioner in the commission of the offence. The learned counsel for the petitioner further submits that the petitioner has a permanent abode at Pidimgoyyi Village, Rajamahendravaram Rural Mandal, and there is no possibility of his fleeing away from the Jurisdiction of the Court.
4. Learned Assistant Public Prosecutor, while opposing the prayer of the petitioner, submits that the investigation is not complete. When ascertained the learned Assistant Public Prosecutor confirmed that the petitioner has no criminal antecedents.
5. In view of the facts and circumstances of the case, since the petitioner herein is arrayed as accused basing on the mediators report and the most of the witnesses are shown to be official witnesses, this Court is inclined to grant anticipatory bail to petitioner/Accused, on the following conditions;
6. The petitioner/accused is directed to surrender before the Station House Officer concerned within two (2) weeks from today and on such surrender, the petitioner/accused shall be released on bail on his executing a personal bond for a sum of
