Mr. Abhishek Verma, learned counsel for the applicant through V.C. 2. Mr. V.S. Pal, learned A.G.A. for the State. 3. The present applicant ‘Anil Rawat’ S/o Shri Balwant Singh is praying for regular bail in relation to First Information Report dated 24.03.2025 bearing FIR No. 0108 of 2025 P.S. Vikasnagar, District Dehradun, wherein, the present applicant has been implicated for the offence punishable under Section 8/20 of NDPS Act. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and the alleged contraband, which is charas, is shown to be recovered from the applicant is below a commercial quantity i.e. 904 grams. Apart from this, he submits that the applicant is languishing in jail since 25.03.2025. 5. He submits that there is no proper compliance of Sections 42, 50 and 52 A of the NDPS Act. 6. Counter affidavit has been filed, however, this fact has been denied that there is no proper compliance of provisions of the NDPS Act, however, it has not been disputed that the alleged contraband, which is shown to be recovered from the present applicant, is below a commercial quantity. 7. Apart from this, the respondents have also not denied this fact that the applicant have no previous criminal history; however, he submits that the chargesheet has not been filed as yet. 8. After hearing the arguments of learned counsel for the parties and further taking into consideration that the alleged contraband, which is shown to be recovered from the present applicant, is below a commercial quantity, and furthermore the applicant have no previous 2025:UHC:3233 criminal history, this court is of the view that the applicant deserves for bail. 9. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 10. Let the applicant ‘Anil Rawat’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
