By way of instant application filed under Section 5 of Limitation Act, prayer has been made on behalf of the applicant-petitioner for condonation of delay in maintaining the accompanying review petition, which is barred by limitation.
Reply on behalf of respondents No.4, 6 and 9 has been filed, whereas no reply is intended to be filed on behalf of respondents No.5, 7 and 8 on whose behalf, submission has been made that they be permitted to adopt the reply filed on behalf of respondents No.4, 6 and 9. Ordered accordingly. If the reply is perused in its entirety, prayer for condonation of delay has been opposed on the ground that no plausible explanation has been rendered to condone the delay in filing the Review Petition.
Having carefully perused the averments contained in the application, which is duly supported by an affidavit, this Court finds no impediment in accepting the prayer,
especially when delay caused in maintaining accompanying review petition does not appear to be intentional or willful, rather same has occurred on account of circumstances, which were completely beyond the control of the applicant- petitioner, as such, the same deserves to be condoned.
In view of above, delay of 28 days, which has been otherwise sufficiently explained is condoned. The application is disposed of.
