C/SCA/18954/2016 ORDER DATED: 03/07/2025 IN THE HIGH COURT OF GUJARAT AT AHMEDABAD R/SPECIAL CIVIL APPLICATION NO. 18954 of 2016 ========================================================== THAKARSHIBHAI RUGNATHBHAI CHAVDA Versus STATE OF GUJARAT & ANR. ========================================================== Appearance: MR VICKY B MEHTA(5422) for the Petitioner(s) No. 1 MR AKASH CHHAYA, AGP for the Respondent(s) No. 1,2 ========================================================== CORAM:HONOURABLE MR.JUSTICE N.S.SANJAY GOWDA Date : 03/07/2025 ORAL ORDER 1. This writ petition is seeking for a declaration that the action of the respondent No.2 is illegal in terminating the services of the petitioner and replacing the existing employee by outsourcing. 2. This Court while entertaining the writ petition had passed an interim order on 14.11.2016 directing the respondents to maintain status-quo with regard to the service conditions and ordered the matter to be heard with Special Civil Application No.3654 of 2013. 3. Today, both the learned counsels submit that the Special Civil Application No.3654 of 2013 was in fact disposed in terms of the orders passed in Special Civil Application No.7462 of 2012. 4. The learned counsel for the petitioner also places on record the decision of this Court rendered in Special Civil C/SCA/18954/2016 ORDER DATED: 03/07/2025 Application No.1241 of 2016 and contends that the subject matter of that writ petition and the subject matter of this writ petition are essentially the same and this Court had disposed of the similar matter in relation to the employee of the same hospital. 5. In the light of the fact that both the learned counsels admit that the issues raised in the present writ petition are covered by the decision rendered by this Court in Special Civil Application No.1241 of 2016. 6. Hence, the present writ petition is DISPOSED OF in terms of the decision rendered by this Court in Special Civil Application No.1241 of 2016 and the reliefs granted to the petitioner therein shall also be conferred on the present petitioner. Rule is made absolute accordingly. Sd/- (NSSG,J) OMKAR Original copy of this order has been signed by the Hon'ble Judge.
