The Writ Petition is filed seeking the following prayer:
“……..to issue a Writ of Mandamus or any other appropriate Writ or Writs Order or Direction declaring the action of Respondents in trying to stop supplying essential commodities to the petitioner without passing any order either suspending or cancelling the dealership of the petitioner, as illegal and arbitrary and to consequently direct the Respondents to forthwith supply essential commodities to the petitioner and allow her to function as Fair Price Shop Dealer of F.P. Shop No. 1257048 of Appalakunta Village, Hindupur Mandal, Sri Sathya Sai District, by regularly supplying essential commodities and pass such other order or orders……”

The case of the petitioner is briefly as follows: (a) The petitioner was appointed as a fair price shop dealer for Shop No. 1257048, Appalakunta Village, Hindupur Mandal, Sri Sathya Sai District, vide proceedings D.Dis.K6/2900/2019, dated 01.10.2019. Since the date of her appointment, the petitioner has been distributing essential commodities to cardholders without any interruptions. While things stood thus, on 05.01.2025, the Tahsildar, Hindupur Mandal, Sri Sathya Sai District, and his team inspected the petitioner’s shop and alleged variation of stocks i.e., Rice by +454 kgs and Sugar by +111 kgs, proposing to cancel the petitioner’s fair price shop authorization. Upon receiving the
3 BSB, J W.P.No.2013 of 2025 show-cause notice, the petitioner submitted a detailed explanation. However, without properly considering the explanation, the 3rd respondent issued the impugned proceedings. Hence, this writ petition. 3. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies appearing for the respondents. 4. The learned Assistant Government Pleader submitted that he has not received written instructions in this regard. 5. Since, as on date, no disciplinary action has been taken against the petitioner, supply of essential commodities cannot be denied as long as the authorization is in force. 6.
In the result, the Writ Petition is disposed of, with a direction to the respondents to supply the essential commodities to the petitioner and allow the petitioner to continue as FPS dealer for which she has license, if she complies other formalities in the regular course, until any action is taken against the petitioner without violating law and principles of natural justice. However, this order does not preclude the authorities from taking any action against the petitioner as per law, if there is any irregularity. There shall be no order as to costs.
