The petitioner has been made accused in connection with Garhwa P.S. Case No.405 of 2024 for the offences registered under Section 126(2), 115(2), 118(1), 109, 3(5) of the B.N.S., 2023, pending in the Court of learned Chief Judicial Magistrate, Garhwa. On 24.07.2024 at about 6:00 A.M., there was free fight between the informant party and accused persons over land dispute. It is alleged that the accused persons assaulted the informant causing grievous injuries on his person. Learned counsel for the petitioner submitted that there is land dispute between the parties. It was further submitted that there is case and counter case with regard to the same occurrence. It was finally submitted that some of the accused persons have been granted anticipatory bail by Co-ordinate Bench of this Court vide A.B.A. No.85 of 2025. Learned A.P.P. has opposed the prayer for bail. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Garhwa, in connection with Garhwa P.S.
