1. This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No. 04/2024 registered at Police Station Piperchhedi, District Gariyaband (CG) for the offences under Sections 302 of IPC.

The prosecution story, in brief, is that on 23.01.2024, the wife of deceased lodged a report that on the date of incident, her husband Jujhar Singh came to her working place and told the incident caused by his brother, wherein the present applicant assaulted the deceased A ANNAJEE RAO Digitally signed by A ANNAJEE RAO Date: 2025.08.15 09:37:42 +0530
2 by lathi, stick, hands and fists. After sometime, the deceased has died as a result of the assault. .

Learned counsel for the applicant submits that the applicant happens to be brother of deceased and only on the basis of suspicion, he has been arrested and there is no incriminating evidence against him to connect him with the crime in question and the applicant has been falsely implicated in this case. He submits that the eye-witness who is sister has been examined and she has turned hostile to the prosecution. He submits that the applicant is in jail since 24.01.2024, and till date out of a total 21 prosecution witnesses, only 9 have been examined and there is no immediate possibility of disposal of trial, therefore, he may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail application and submits that the applicant is accused of committing murder of his brother and the trial is in progress.
5. Having considered the submissions made by learned counsel for the parties and the facts and circumstances of the case, I am not inclined to release the applicant on regular bail, at this stage. Accordingly, the bail application is rejected.
6. However, looking to the long custody period of the applicant and considering the matter to be an exceptional one, the trial Court is
directed to conclude the trial as early as possible preferably within a period of 5 months from the date of receipt of copy of this order.
7. Copy of this order be sent to the trial Court for information. Sd/-
