1.PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya 2023 (for brevity ‘the BNSS’) by the Nagarik Suraksha Sanhita Petitioners/Accused Nos.4, 7 and 10 for granting of pre-arrest bail in connection with Crime No.179 of 2021 of Pedakurapadi Police Station, Palnadu District, registered against the Petitioners/Accused Nos.4, 7 and 10 herein for the offences punishable under Sections 294, 509, 506 and 306 read with 34 of the Indian Penal Code, 1860 (for brevity ‘the I.P.C). a 2 Heard the learned counsel for the petitioners and the learned Assistant

This Court, in CrI.P. No.12164 of 2025, by order dated 28.11.2025,
3. granted bail to Accused Nos.1,2, 3, 5, 6, 8, 9, and 11 on the ground that there were no severe allegations and that the allegations were omnibus in nature. Even against the present petitioners, who are arrayed as Accused Nos.4, 7, and 10, it is only alleged that they, along with the other accused, came to the house of the de-facto complainant and abused his wife in filthy language. Except for this allegation, no specific overt acts are attributed to the petitioners. On a careful perusal of the record, it is seen that the wife of the de-facto
4. complainant, by name Rani, was found hanging from the ceiling fan with her saree. Prior thereto, on 11.11.2021 at about 9:00 p.m., all the accused allegedly went to the house of the de-facto complainant and abused him and his wife in filthy language, as the de-facto complainant had informed others about an alleged illicit relationship between two persons in the village. So far, twenty-three witnesses have been examined, and the material portion of the investigation has been completed. Considering the facts and circumstances of the case, gravity and nature
5. of the allegations levelled against the Petitioners/Accused Nos.4, 7 and 10, this Court is inclined to grant pre-arrest bail to thePetitioners/Accused Nos.4, 7 and 10. 3
6. In the result, the Criminal Petition is allowed with the following conditions: i. In the event of their arrest, the Petitioners/Accused No.4, 7 and 10 shall be enlarged on bail subject to they executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only), with two sureties for the like sum each to the satisfaction of the arresting police officials; ii. The Petitioners/Accused No.4, 7 and 10 shall make themselves available for investigation as and when required; iii. The Petitioners/AccusedNo.4, 7 and 10 shall not cause any threat, inducement or promise to the prosecution witnesses; iv. The Petitioners/Accused No.4, 7 and 10 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet.
V. The Petitioners/Accused No.4, 7 and 10 shall not leave the district limits without the express permission from the Station House Officer concerned, vi. The Petitioners/Accused No.4, 7 and 10 shall surrender their passport, if any, to the investigating officer. If they claim that they do not have passport, they shall submit an affidavit to that effect to the Investigating Officer.
