Mr. Saurabh Kumar Pandey, learned counsel for the applicant. 2. Mr. V.S. Pal, learned A.G.A. with Mrs. Meenakshi Sharma, learned Brief Holder for the State. 3. The present applicant ‘Vinay Kumar alias Vanshu’ is praying for regular bail in relation to First Information Report dated 16.10.2024 bearing FIR No. 417 of 2024, P.S. Kiccha, District Udham Singh Nagar, which was lodged against unknown persons for the offences punishable under Sections 64, 87 and 137(2) of BNS, 2023. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and furthermore the chargesheet has already been filed and, therefore, there is no need of custodial interrogation. 5. Apart from this, he submits that though the victim was minor but the applicant was also at the tender age of 19 years at the time of alleged incident and both of them were in love with each other, which is evident from the statement of the victim recorded under Section 183 of BNSS, 2023. 6. On the other side, the State counsel have not disputed this fact that the chargesheet has already been filed, therefore, there is no need of custodial interrogation of the applicant. 7. After hearing the arguments of learned counsel for the parties and further taking into consideration that the chargesheet has already been filed, therefore, there is no need of custodial interrogation of the present applicant, this court is of the view that the applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 9. Let the applicant ‘Vinay Kumar alias Vanshu’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
