The present applications were filed seeking to vacate the interim order passed by this Court on 09.05.2025 directing the respondents not to take up any further promotions, till further hearing of the Writ Petition and modification of the interim Order dated 09.05.2025. Heard Sri M.Vijay Kumar, learned Senior Counsel for the Writ Petitioner and Sri M.Solomon Raju, learned counsel for the Respondent Nos.4 to 12 and Sri Aravala Rama Rao, learned Standing Counsel for Respondent Nos.2, 3 and 13. The Writ Petition was filed to declare the Proceedings No.EA/255(2)/2024-PD-1, dated 03.01.2025 and Proceedings No.EA/ 255(2)/2024 dated 27.01.2025 issued by Respondent No.3 where under the unofficial Respondent Nos.4 to 12 were appointed as Depot Managers, as being contrary to the Andhra Pradesh State Services Rules, 2023 and the Notification No.PD-05/2019 dated
19.03.2019. Sri M.Vijay Kumar, learned Senior Counsel appearing for the Writ Petitioner would submit that the appointment of the unofficial Respondent Nos.4 to 12 is contrary to the Rules as well as Notification dated 19.03.2019, wherein 50 points Roster was formulated catering to various Feeder Category Departments as provided under the Rules and therefore, the impugned proceedings cannot be sustained under the law. Sri Aravala Rama Rao, learned Standing Counsel for Respondent Nos.2, 3 and 13 would contend that for the present the interim Order dated 09.05.2025 may be modified by enabling the Respondent Corporation to fill up the vacancies in the cadre of Depot Manager, as the interim order is hampering the administration of the Respondent Corporation. He would further submit that the promotions to the post of Depot Manager will be made strictly in accordance with the Annexure-I of Rule 3, Class-IV Category (3) Sl.No.14 of the Andhra Pradesh State Services Rules, 2023. Sri M.Solomon Raju, learned counsel for Respondent Nos.4 to 12 while supporting the arguments of learned Senior Counsel would submit that further promotions be affected in terms of the Rules in vogue.
Having heard the respective counsels, interim Order dated 09.05.2025 passed by this Court is modified to the extent of enabling the Respondent Corporation to effect promotions to the cadre of ‘Depot Manager’, strictly in accordance with the Annexure-I of Rule 3, Class-IV Category (3) Sl.No.14 of the Andhra Pradesh State Services Rules, 2023 and the Notification No.PD-05/2019 dated 19.03.2019, by adhering strictly to the Roster point issued for filling up of the vacancies. Any deviation by the Respondent Corporation in effecting promotions to the post of ‘Depot Manager’ would be viewed as a contempt of Court. Accordingly, these applications are ordered.
