The Court made the following ORDER:
The present writ petition is filed questioning the inaction of the 3rd respondent in renewing passport of the petitioner in pursuant to the application No.L4086994, dated 02.09.2025, on the ground that a criminal case is pending against the petitioner in C.C.No.424 of 2024 in Cr.No.62 of 2024 for the offences under

Section 329(3), 324(2) r/w 3(5) of BNS, 2023 before the Court of Judicial First Class Magistrate, Venkatagiri.
2. Heard Sri Navuluru Krishna Sai, learned counsel for the petitioner, Sri Jupudi V.K. Yagnadath, learned Central Government Counsel appearing for respondent Nos.1 to 3 and learned Government Pleader for Home.

Learned counsel for the petitioner submits that as passport issued in favour of the petitioner on 26.05.2014 got expired, before its due expiry, an application dated 02.09.2025 is made seeking renewal of the same under the provisions of the Passports Act, 1967. However, the said application has not been considered on the ground that a criminal case is pending against the petitioner in C.C.No.424 of 2024. Therefore, petitioner preferred present writ petition.

Learned counsel for the petitioner as well as learned counsel for the respondents would submit that the Division Bench of this Court in W.A.No.383 of 2024, by order dated 29.10.2024, considering a similar issue has relegated the appellant/writ petitioner therein to make application before the jurisdictional Criminal Court for both renewal and as well as travel permit.

Therefore, even the present writ petition can be disposed of in terms of the said directions.

In view of the same, the Writ Petition stands disposed of by granting liberty to the petitioner to make appropriate application before the jurisdictional Criminal Court seeking direction to the respondent-passport authority for renewal of the passport and if necessary, permission to travel. If any such application is made before the jurisdictional Court, the same shall be considered in accordance with law and pass appropriate orders by affording due opportunity to both the petitioner as well as passport authority within a period of four (04) weeks from the date of receipt of a copy of this order. No costs. Miscellaneous petitions pending, if any, shall stand closed. ______________________________ JUSTICE CHALLA GUNARANJAN
