The petitioner no.2 has been arrested pursuant to the writ petition having been preferred. The petitioner no.1 is a minor, who through her mother has preferred a writ petition along with the petitioner no.2.
The investigation is in progress as is reflected from the report submitted by the State in connection with Bally P.S. Case No. 141 of 2024 dated 03.11.2024 under the relevant provisions of BNS, POCSO Act, 2012 and Prohibition of Child
2 Marriage Act, 2006.
In view of the relevant provisions of POCSO Act, 2012 and Prohibition of Child Marriage Act, 2006, I am of the view that, at this stage, the prayer(s) so canvassed before this Court for quashing of the said case cannot be interfered with.
With the aforesaid observations, WPA 30381 of 2024 is disposed of.
