IA.No.1 of 2025 is filed under Section 359(6) read with Section 528 of BNSS, 2023, by the Petitioner/defacto Complainant seeking permission to compromise the matter with the respondent/Accused by quashing the Proceedings in Crime No.212 of 2025 on the file of Vinukonda Police Station, Palnadu District, registered for the offences punishable under Sections 115(2), 351(2) of BNS, 2023 and Sections 3(2)(va), 3(1)(r) and 3(1)(s) of Scheduled Castes and Scheduled Tribes (PoA), Act . 3. IA No.2 of 2025 is filed under Section 359(2) read with 528 BNSS, 2023 requesting to record compromise in Crime No.212 of 2025 on the file of Vinukonda Police Station, Palnadu District. 4. The 2nd respondent in the Criminal Petition, who is the Defacto Complainant filed a complaint against the petitioner/Accused alleging that on the date of offence, while the respondent No.2/ de facto complainant and his wife were present at the scene of offence, Petitioner along with his brother were going on bike with high speed. Respondent No.2 questioned about the driving of the vehicle in high speed, for which, petitioner allegedly stated that he is the President, nobody can stop him, Petitioner allegedly beat the complainant on his private parts with his legs, abused him touching name of the caste, 3 threatened him. Respondent No.2/ de facto complainant gave a complaint to the police, which is registered as a case, as stated above. This criminal petition is filed by the Petitioner/Accused seeking quashment of the proceedings against him. 5. During pendency of this Criminal Petition, the parties made a request before this Court that they intend to compromise the matter and accordingly, IA Nos.1 and 2 were filed. 6. The parties are identified by their respective counsels on record. Copies of the Aadhar cards of the parties attested by their respective counsels are filed for proper identification. Ms. K. Priyanka Lakshmi, learned Asst. Public Prosecutor representing the State is also in attendance and submitted that the court may pass appropriate orders. 7. The parties filed compromise petition as stated supra stating that the matter is compromised between them and also filed a Joint Memo, which reveals that the parties are residents of same village and at the intervention of elders, the parties decided to settle the issue amicably and the respondent No.2 agreed to withdraw the case against the accused in the above Crime. 8. The 2nd respondent submitted that he has no dispute with the accused and there is no coercion and undue influence for settling the issue with the accused. It is only to keep harmony between them, the issue is resolved amicably and he has no objection to record compromise in this matter. Further, the 2nd respondent expressed his willingness to deposit the compensation 4 amount, if any, received from the government, back to the government, including any such amount he would receive in the future, regarding this case. 9. Considering the submissions, in the interests of justice, I.A.Nos.1 and 2 of 2025 are allowed. Consequently, this Criminal Petition is allowed and the Proceedings in Crime No.212 of 2025 on the file of Vinukonda Police Station, Palnadu District against the Petitioner/Accused are hereby quashed. The Registry is directed to communicate a copy of this order to the Collector of concerned District for taking necessary steps to recover the compensation amount, if any, paid to the de facto complainant, regarding this case.
