Jini, learned Legal Aid Counsel for the applicant, who has filed the instant application under Section 5 of the Limitation Act, 1963 for condonation of delay of 407 days in filing the connected criminal appeal being Crl.A.(J) No. 6 (AP)/2024 against the judgment and order of conviction dated 16.06.2023, passed by the learned Sessions Judge, Tezu Lower Dibang Valley Page No.# 2/2 District in Tezu Sessions Case No. 15(LDV)/2021 under Section 302 of the IPC and under Section 27 (1) of the Arms Act, wherein, the applicant was convicted/sentenced to undergo life imprisonment with a fine of Rs.10,000/-. 2. Issue notice to the respondent. 3. As Mr. G. Tado, learned Additional Public Prosecutor entered and accepted notice on behalf of the State respondent, no formal notice is required to be issued. 4. Mr. Tado, learned Additional Public Prosecutor has submitted that, since it is a jail appeal, he has no objection if the condonation application in filing the connected appeal is allowed. 5. We have considered the submissions of the learned counsel appearing for the parties and we find it appropriate to condone the delay of 407 days in filing the connected appeal against the judgment and order of conviction dated 16.06.2023, passed by the learned Sessions Judge, Tezu Lower Dibang Valley District in Tezu Sessions Case No. 15(LDV)/2021 under Section 302 of the IPC and under Section 27 (1) of the Arms Act. 6.
