1. This writ petition has been filed with a prayer to execute an order passed by the Additional District and Sessions Judge/Special Judge, POCSO, Hapur, dated 28.5.2018, whereby a direction has been issued to pay the victim a sum of Rs.1,00,000/- towards rehabilitation. On the previous occasion, this Court had passed the following order :
"1. This Court on 05.04.2025 had directed learned Standing Counsel to obtain specific instructions in the matter from District Magistrate, Hapur as to why the amount directed to be paid to the victim has not been released, so far.
2. Despite such order passed, no instructions are obtained from the concerned District Magistrate.
3. In that view of the matter, we direct this matter to be listed once again amongst top ten cases on 07.05.2025 by when the District Magistrate, Hapur shall file his personal affidavit in compliance of the previous order passed, failing which the Court shall proceed to summon the officer himself."
2. An affidavit has been filed by the District Magistrate, Hapur, on 9.5.2025 stating that the writ petitioner has already been paid Rs.7,00,000/- under the State scheme for rehabilitation, which fact was not before the Court when the direction was issued to pay Rs.1,00,000/-.
3. It is stated that since the petitioner has already received much more amount and such fact was otherwise not within the notice of learned POCSO Judge when the direction was issued, the writ petitioner is not entitled to any relief.
4. Learned counsel for the petitioner does not dispute the fact that sum of Rs.7,00,000/- towards rehabilitation has already been paid to the victim towards the rehabilitation. Once that be the case, we do not find any occasion for this Court to issue any direction to pay any further compensation to the victim.
5. The writ petition is, therefore, consigned to record. Order Date :- 27.5.2025/DKS Digitally signed by :- DEEPAK KUMAR SRIVASTWA High Court of Judicature at Allahabad
